Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and WaxTrading ("WaxTrading", "we", "us") governing your access to and use of the WaxTrading marketplace, website, and mobile applications (the "Service").

1. Eligibility

You must be at least 18 years old and legally able to enter contracts to use the Service. By using the Service you represent that you meet these requirements.

2. What WaxTrading Is (and Isn't)

WaxTrading is a peer-to-peer marketplace connecting buyers and sellers of sealed sports cards, trading card game (TCG) products, and related collectibles. WaxTrading is nota party to any transaction between users. We do not take custody of inventory, do not process shipment, and (unless you use an optional escrow service we specifically offer) do not hold funds on behalf of users.

3. Accounts

You are responsible for maintaining the security of your account and for all activity that occurs under it. Notify us immediately of any unauthorized use.

4. Membership Plans and Fees

Access to certain features requires a paid membership. Fees, billing intervals, and included features are described on our Pricing page. Memberships auto-renew until canceled. On iOS, memberships purchased through the App Store are billed by Apple under Apple's terms; cancel through your Apple ID subscription settings.

5. Listings and Deals

Sellers are responsible for the accuracy of listings including product condition, seal status, quantity, and price. Buyers are responsible for reviewing listings before offering. Once a buyer and seller agree to terms in a deal room, both parties are expected to complete the trade in good faith.

6. Prohibited Conduct

• Listing counterfeit, resealed, or misrepresented product.
• Circumventing the platform to avoid membership fees or evade dispute processes.
• Harassment, hate speech, or threats toward other users.
• Using the Service for money laundering, fraud, or any illegal purpose.
• Automated scraping or reverse engineering of the Service.

7. Dealer Verification

Verified dealer status is granted at WaxTrading's discretion based on documentation you submit. We may revoke verification at any time. Verified status does not constitute an endorsement or guarantee of any user's conduct.

8. Disputes Between Users

If a deal goes wrong, use the in-app dispute process. WaxTrading may, at its discretion, freeze a deal, request additional information, mediate, or restrict accounts, but is not obligated to resolve disputes and is not liable for user-to-user losses.

9. Intellectual Property

The Service, including its design, code, and content produced by WaxTrading, is owned by WaxTrading and protected by intellectual property laws. Product names, logos, and set names are the property of their respective owners.

10. Termination

We may suspend or terminate your account at any time for violation of these Terms or for conduct we reasonably believe harms other users or the Service.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WAXTRADING'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.

13. Governing Law

These Terms are governed by the laws of the State of New York, United States, without regard to conflict-of-law principles.

14. Changes

We may update these Terms from time to time. Material changes will be announced in-app or by email. Continued use after changes take effect constitutes acceptance.
